La decisi\u00f3n, con ponencia del magistrado Jorge Hern\u00e1n D\u00edaz Soto, se fundamenta en la extrema pobreza del condenado y reitera los requisitos esenciales para la asignaci\u00f3n de esta responsabilidad.<\/p>\n\n\n\n<p>H\u00e9ctor Julio, quien se desempe\u00f1aba como cotero en la plaza de mercado de Ibagu\u00e9, fue sentenciado por no aportar el 25% de su salario destinado a la manutenci\u00f3n de su hijo. Sin embargo, la Corte determin\u00f3 que los jueces de instancia incurrieron en errores de apreciaci\u00f3n probatoria al presumir que el hombre pose\u00eda la capacidad econ\u00f3mica para cumplir con dicho pago.<\/p>\n\n\n\n<p>El magistrado ponente argument\u00f3 que la precaria situaci\u00f3n econ\u00f3mica de H\u00e9ctor Julio, quien trabajaba cargando bultos en la plaza sin una actividad laboral permanente ni ingresos fijos, y adem\u00e1s viv\u00eda en una zona de invasi\u00f3n en Ibagu\u00e9, le imped\u00eda generar los recursos necesarios para cubrir la cuota alimentaria sin poner en riesgo su propia subsistencia.<\/p>\n\n\n\n<p>La Corte Suprema record\u00f3 que la obligaci\u00f3n alimentaria se sustenta en dos pilares fundamentales: la necesidad del beneficiario y la capacidad econ\u00f3mica del deudor.
